Sign Classifications – Revised (1/22/07)

Signs Regulated by the Kansas Highway Advertising Control Act (KHACA).  The following signs are regulated by the Kansas Department of Transportation (KDOT) on controlled outdoor advertising routes.  No sign shall be built without first obtaining a permit to build from KDOT.  Once built, all signs shall also be required to obtain a license for each sign structure.

Legal Conforming (LC).  Legal conforming signs are located in industrial or commercially zoned areas.  The advertising structure shall comply with KHACA regarding spacing, size, and licensing.  These signs cannot be erected on scenic byways.  Please refer to KHACA for more information.

1W #000901.jpgW# 000358.jpg

Legal Nonconforming (LN).  Legal nonconforming signs are signs built prior to 1972 and before being subject to the KHACA.  These signs are usually located in agricultural or residential zoned areas and may or may not comply with the KHACA regarding spacing, size, etc.  Any alterations or repairs to such signs may result in loss of their legal nonconforming status.  Signs which have lost their legal non-conforming status are illegal.  Please refer to KHACA for more information.

Signs Exempt from License Fees or Permit Fees

Official (OF).  Official signs must be erected and maintained by public officers or public agencies within their prescribed territories or zoning jurisdiction pursuant to the authorization contained in federal, state, or local law for carrying out an official duty or responsibility. Historical markers authorized by state law and erected by state or local government agencies or nonprofit historical societies are considered Official signs.  These signs can be erected on all controlled outdoor advertising routes. There is a size limitation of 30 feet in sign-face height and 60 feet in length or 900 square feet in area.  (The configuration and size limitations for signs may be found at K.S.A. 68-2234(b).)

1 # 004152.jpg1 # 003851.jpg

Directional (DI).  Directional signs pertain to natural wonders, scenic attractions, or historical attractions.  They contain directional information about public places owned or operated by federal, state, or local governments or its agencies.  This includes publicly or privately-owned natural phenomena, historic, cultural, scientific, educational and religious sites, areas of natural scenic beauty or areas naturally suited for outdoor recreation, which are deemed to be of interest to the traveling public.  The message on signs should identify the attraction or activity and directional information useful to the traveler in locating the attraction, such as mileage, route numbers, or exit numbers. Descriptive words or phrases and pictorial or photographic representation of the activity or its environs are prohibited.  These signs can be erected on all controlled outdoor advertising routes but are limited to the number erected. There is a size limitation of 150 square feet in area.
